Disclaimers on websites: Necessary or no?
We don't have a disclaimer on my company's website. Do I need to include one, and if so, why?

it might help if you get sued about something to do with the site? I don't know. Necessary from a legal perspective: probably. But personally I don't see the point.

I feel its always important, especially on a corporate site to include a "Terms and Conditions" and a "privacy policy". Both of these documents should be linked on every page via a footer (or something else subdued) and will contain all the legal jargon pertaining to use of brand / logo / identity, use of domain in media and/or publishing aims, etc. etc.
The real function of these documents is to say two things: "We're professional" and "We've got lawyers, so you better have at least 3 before even thinking of suing us - for anything."

Depends what the content/goal of the website is, really... I doubt any website disclaimer would stand up in court, anyhow.

It's a question I've posed to our legal guy and I'll post his response when I get it.
My company is a financial company and we do transactions online. Our competition has disclaimers, so I'm just curious as to why we've never had them on our site. We're in court all the time for various reasons as-is (fraud, bankruptcy, etc) and I don't know that having a disclaimer on our site has ever been brought up. |

If required by law, the disclaimers are, well, required by law. Otherwise it's just a notice as indicated above "we have lawyers, or at least know how to find one in the phone book, so restrict your frivelous lawsuits to asbestos claims and go away"
Examples where notices are required: - Commerce (terms/conditions) - Employment (e.g. "Company XYZ is an Affirmative Action and Equal Opportunity Employer, M/F/D/V") And probably anytime personal information is collected (privacy terms).

Another short-coming of Google. When I asked if Terms and Conditions are required by law, all it gave me was page after page of T&C pages from websites.
Perhaps iGrep will know. |

I've wondered this same question. I'm building my site, and wasn't sure what the proper thing to do would be. Also if I did decide to put up a TaC/PP would I have to hire a lawer to write one for me, or is there a place where I learn to create one myself (one that holds water). I'm not sure what the correct course of action is.
