Domain Name copyrights issue
Hi
i want to ask a domain name copyrights, or you can say trade mark copyrights issue: following the forum rules i am using dummy names,. say I have a domain name www.starcompany.com and i sell stars, can someone signup for a domain like www.fivestarcompany.com or www.starcompanyplus.com and do the same business as i am doing i.e selling stars? ![]() please share your wise words. thanks in advance

Sadly jojoba yes they can, however if you were to signup as microsooft.com and sell OS software they can come down on you. The reason? Because if the domain can be easily confused with yours then you have the right to have them change their name or buy the domain.
It's an open market here in the states, and that's really our laws. I don't know international law, and for that matter I don't pretend to know American law. I just know that I have seen cases of companies going after other companies because they sound similar in names. Chad

thanks chad for informative post. but i have seen cases where some companies have domains like www.sellthis.com and some other similar company have names like www.sellthis.net
if this is allowed to register a copyright case on some company just bacause it has similar name and business then why people dont buy complete series of domains matching with their company name? |

Copyright has nothing to do with it. It's trademark infringement and case by case. Trademarks are more serious, they get the more muscular lawyers to handle those cases than a simple slap on the wrist copyright guy (despite what you've heard from the RIAA thugs)
If you're in the exact same business as a pre-existing company and mimicking their name you're asking for it ...

When it comes to large corporate name it is better to check whether it is infringing upon their trade mark, but not so necessary for unique and common name that you are going to pick up.
Both Canada and the US have publicly searchable databases of trademark and copyright information, you can check it through their database to make sure about it. |

After discussing this issue with you guys (thanks God I discussed it) I have reached the conclusion "not to make waves"
bcz I dont want to work so hard on a domain and after sometime when i am cashing my time some chap send me a legal notice of trademark infringement so it is better that i go with a unique domain name ..thanks guys, it was really helpful discussion, +100 points to all of you ![]() |

Yeah that is the safest idea there. How about start the same type of company just not with the company name being close, nor the domain name being anywhere close. That way they can't really get too offended. It's not like you are stealing trade secrets ... or are you?
