Got infected, entire site is lost
i run a few forum websites. apparently i didn't update versions in time and got some malicious users who did some stuff.
now my webhost won't let me download any backups of any sort...my site is gone. all the users i have...gone. is there anything i can do or am i just screwed? p.s. phpBB sucks ace-host.net sucks |

Your webhost won't let you download any backups, whaaat? Are there backups? What reasons did they give?

yeah there are backups.
because i guess someone used it for phishing, and if there is private info such as SS#'s, credit card #'s, etc. they would be liable if they released it. |

You're the client as such it's your responsibility, not theirs, I'd be on to my attorney tout suite. At the very least it's shared responsibility, and while it's magnaminous of them to play the part of shouldering total accountability, your a55 will probably end up being hauled into court if it's the case requires it.
ASSUMPTION::The backup is part of the service they offer you, check your terms and conditions, does it mention that in the event of an exploit that they may and/or may not withhold any deliverable of their service to you. I'm not saying it is, and I'm not saying it isn't, but there exists a possibility that their error caused the breach, and by denying you access to the logs/backups/forensics they're actually denying you the right to defend yourself if that is indeed the case. Talk nicely, if that doesn't work, talk to a solicitor, and look for an injunction to close their business (just kidding), try the nice approach and let me know how you get on. Definitely talk to your lawyer. You need to consider the value of the content, though. Is it really worth the effort? Was the content on those forums worth going through the hassle of re-obtaining?
