Pokemon website legal issues

I was wondering what the rules are in regards to using Pokemon characters and names on your website?

I’m creating a graphical chat (with different Pokemon as the avatars) that will use ALL my own (well my artist’s) artwork.
I will be receiving ad revenue from the website though. Do you think Nintendo will put a stop to this, or even ask for their cut?

Apparently they even promote sites like pokemoncrater.com so I’m not sure were I stand with this. I guess they could go after them (and me) legally if they want but just choose not to?

Check with them to see if you can legally license or be granted the right to run a fansite and what the rules are for that. Chances are good this info is readily found.

They'd be the ones to set the rules. If you don't play by their rules then yes they can send a cease and desist and/or litigate as you are violating copyright.

Can you get away with it? Probably. Should you take the risk? Probably not.

If it is a commercial venture, as opposed to an educational one, you are probably imposing on their copyright and would not be in a good long-term position. Just imagine if any large toy manufacturer decided to do what you want to do. I doubt that they would come after you, since it is not worth it, but if it came to their attention, you might get a letter in the mail.
