Let says there is a open source BBS programmed in CGI (Chinese). I ask someone to translate to english and reprogrammed it in PHP. Do I get the exclusive right of owning the script and to sell the PHP script?

I'd say make sure to have a signed contract with explicit terms that your translators do not get any rights to the program. That won't stop any theft but you will have legal course of action should it be neccessary.

Read the licensing agreement for the original script. "Open Source" is a broad definition. In most cases you can modify the original script but your version would also be GPL.
