Hello,
I am wanting to use the name "voom" for my company and domain name. Although, http://www.voom.tv/ uses this name, there is no mention of the name being a "registered trademark" in the copyright disclaimer, neither is there a TM or R logo next to the name, also in their disclaimer they refer to themselves as VOOMHD and not VOOM. The copyright statment at the bottom of the page is dated 2006. Another company "voom.net" state in their copyright disclaimer that "voom" is a registered trademark, although the copyright is dated 1997-2007. I am a assuming because these copyrights are out of date it is possible for me to use the name, although if the above companies renewed their copyrights would i still be able to use the name? Simple question, can i use the name "voom" , note it would not be used on its own it would be used in a name like "voommedia.com". When i do a trademark search here http://tess2.uspto.gov/bin/gate.exe...h=&p_s_ALL=VOOM there are loads of results, surely i will be able to use the name then if there is 10+ companies all using it? Looks like i tick the boxes then, although when i do a google search for companies using the name "voom" and our in the same market as my company (making them in competition), but they don't have a R logo or TM logo or any mention of trademarks; just the "All Rights Reserved". I presume that wont put me in any danger as they have the right to use the name "voom" just as much as I do because they haven't expressed any notice of ownership of the name.
