That question depends on the license for the script your using
If you purchased the script for the site
The ownership of the script would normally transfer with the site itself. Much like when you sell a tangable business, you sell the assets and debts as well
If the script is GPL, Berkeley, or similar license
You can do anything you want with the scripts
If the script is licensed differently
You will want to look at the license for anything referencing tranfer of ownership. If you cannot locate anything inside the script its best to contact the script author and ask if the ownership is transferrable if the original copy is destroyed.
To explain my last statement most software runs on a 1 license = 1 site / 1 computer type license. So If the original copy no longer exists but now exists on a second computer or second site, then its okay.
Just make sure you cover your ***.
