I'm not sure I understand exactly what you're looking for. Are you trying to become a business and you want to get a license so no one else can use your name?
If that's the case, you need to get a business license through your state department. If you're asking something different, explain ![]() |

Not true at all. I am really starting to get put off my the amount of wrong advice given here. Getting a business license does NOT prevent someone else from using the same name. He does indeed need a trademark to protect his name from other people that are in the same trade. Anyways, the link above my place is a good starting place. Trademarks will cost you a few hundred dollars and I recommend contacting a corporate lawyer to help you so everything gets done correctly. |

To expand a little further on the business license issue.
A sole proprietor license can have the same name as another sole proprietorship. With an LLC or Corporation license, only one company can be licensed with that name. I'm not sure if this is a nation wide check or only a state wide check though. As stated above, a corporate lawyer would be able to answer these types of questions. |

A sole proprietor can use their own name if it is the same as someone else's, but people typically work under a DBA. You would need to get a local trademark certificate for the DBA to make sure no one is using the same name. When forming a LLC or Coporation and filing with your state, only the same name is checked against other filed names in that state. You need a federal trademark to keep people across state lines from using the same name if they are in the same trade of business. |
