urgent help- fla source

Hi, we are a web devloper in perth western australia. We've been working in the industry for around 4 years now. One of our client ask for the source file of a flash site that we did for them. On the letter of engagement that the client sign, it says that the source code belong to us.

Our questions are:
- What is our right on this (like refusing them/not selling the code to them)?
- Is this normal?
- Can we charge for the source code?
- How much should we charge them? The original project value is $3,500, if that's help.

Your urgent reply is greatly appreciated

Thank you very much

If the contract clearly specifies that you own the code, then this is simply a brand new negotiation to obtain a service from you. If they feel obligated to get the source for free with the expectation that they already paid for it, then either your agreement was not clear or they chose not to interpret it and you may need to litigate (if it is worth your while). As for what to charge if you sell it at all, that is entirely up to you. You may choose to sell/give it to them with a single-use, non-transferable liscense that specifically prohibits them from selling/giving away the product. Presuming you can resell the same or similiar product for the same price a few times, the source is certainly worth more than $3.5K.
