did a psu burn out my 9800 pro?

i recently brought a new pc case complete with psu, when id swapped all the innards and switched it on, my fans led lit up for a moment then went out and my computer refused to boot, i took the psu back to the shop and it was exchanged for a new one, but now when i switch on the comp i got error beeps (8) saying my agp was faulty, it turns out that the faulty psu had fried my 9800 pro, where do i stand in terms of who's responsable? ive sent my 9800 of to HIS for a test report, but when i take it back into the shop wont he just ask me to prove it was working BEFORE the psu was connected?
has anyone any advice on this matter?

most computer stores will just give you the run around, some won't . if the card is new they can just exchange it as a out of box faliure.
