ActionScript 3 - Using XML and geting error

I am using XML var type in actionscript3, I have the following simple line:

var item5:XML = <node></node>;

it always give me the following error:
Unexpected '<' encountered

Can anybody help me with this?

Hi, I copy n pasted that line into a new document and it works for me. Are you sure you have it set to Flash 9 and ActionScript 3 in the File->Publish Settings->Flash panel?

Sorry, I was using AC2 instead of AC3.
I change to AC3 and it works!
