Photoshop CS File Flattens in Photoshop 7

I have a Photoshop CS file in CMYK, 16 bit color per channel. When a fellow illustrator trys to open in Photoshop 7, the layers in the file are flattened.

Any idea on how to get this to open in Photoshop 7 with layers intact?

hi there,
you have to change to 8 bits/channel in cs....if you want to see the layers in ps7.
