There is no law guaranteeing you a backup. You have the option to sue, I guess, in Toronto, or something.
If you have any recent credit card charges for you hosting, dispute them and then move on.

Im sorry to say this but there is a good change they have taken you money and there is no change of getting a backup.
Thats what happened to me ages ago before I decided to move on a get my own server. But I wasted 2 months trying to get my account and information back and in the end no luck. Im not sure why companies do that. Ive started my own web hosting company up and I find it easier to treat the customer nicely because you dont get lots of complaints then which take up alot more time and effort. And there is basically nothing you can do about it to get your money back. ![]() |

No! If you were charged on a credit card dispute! and don't wait until tomorrow. Your time frame is limited. You have a legitimate dispute and most banks will give you credit immediately while they investigate. They send a form, you fill it out, and three months later the bank will tell you the credit they gave you is now yours to keep and the investigation is closed.
Reason for dispute: Failed to provide service and reasonable attempts were made to contact the vendor. |

hmm i too had problems with this hosting company with lots of down time. i was moved there before after the company i was with got brought over by them. There support was terriable and after a very short time our account just vannished? They did not even tell us. I would leave them, but i am abit biased as i did have very bad service with them.

Yes, i think they may have gone
. I once got a dedicated server of the dreaded EBAY with spaceserve. I got it for about a day, then down it went. Spaceserve did a runner . The problem was they made me pay for 3 months for the server. Ebay + Paypal were no help. Lucky that i only had a couple of customers..Well these things happen, there are always people out there to make the odd buck and run, thats the way the world is! Sorry. Regards Steven Billings |

I am not really worried about loosing the money(no choice), I just want to get my sites current backup
:-( it seems more and more hosting companies are doing this .. There has /need to be some LAW to stop this people from dissapearing like this..@ least they should allow us to backup our data.. |

Was the server hosted with the planet?
There was a thread like this about iNetter I think that SOME people were able to get back their data by contacting the datacenter, in that case, ev1. Im sure if you email the planet you may have some chance. Also, follow what medialint said. You need to act fast Regards Steven Billings |

You may want to read the thread on inetter. Just like their clients you don't have a chance at getting the datacenter to help you as your not their client, hostxl was. I hate to say it but this is the situation and it is hard to accept. At the same time I would assume you would have a backup. After reading your posts a lot of you seem to have been fooled. When looking for hosting don't go by price. Ebay is a HORRIBLE spot to by hosting. Consider buying hosting like buying a new Ford Mustang Convertable. Sure you can spend $10,000 on a new one but do you really think that it would be the same quality as a one bought directly from a dealer at $25,000? Obviously not. Checkout webhostingtips.info there are lots of tips on there. Good luck finding a new host and remember the amount you pay should be the last thing you consider. Don't expect a lot of space/bandwidth for nothing as it does cost to have support teams and reliable servers (More then 20 cents per gb bandwidth) |

What hostxl is doing is actually by terms of consumer protection on the lines of fraud and deception. I have been doing alot of research on the company, when i contacted the owners whm host he all of a sudden did not know anything about hostxl, not even the name of the person. I have been on hostxl for only a month and a half and majority of downtime is the same as up time. Which under FTC is called fraud and decption. Which means by that, the terms of service I agreed to is now void, and basically can ask for some kind of agreement to get money back for services NOT rendered. Has anybody able to get a hold of this owner of hostxl. I have tracked him down to where the data center is located (theplanet.com) where you can also put in a complaint to them about their client about what is going on. Also Consumer laws, also are able to go into canada. There could be a class action lawsuit if consumers of the company can come together and do it all at once. It could mean also jail time, and return of money.

Honestly a class action suit is a waste of your time. The legal fees for this and time needed to put together a case would cost you more then the hosting. Chalk it up to experience and remember 'shame on them for tricking you the first time and shame on you if you let it get done again'.

I believe his name was "Goce Kosteski" i have spoke to him many times via phone on 416-4141262 and the previos nos he had on the web site.. in the last week NO ANSWER and also I have sent many SMSs and no reply..
When I did have an issue sometime back and he was unreachable I managed to get another number from 411.ca which matched his address and I called his home(I THINK) and was able to takled to someone else who manged to pass on the message to him.. HOW ever there seem to me NO RECORD on 411.ca now.. (I WONDER WHY??) There only seem to me 3 records for TORONTO are with that SURNAME and I have called them all and no one seem to know if this GUY. Just goin thru my emails I received about 40 emails from HOSTXL.NET on 25th to backup all ACCOUNTS as they are experiensing some problem.. NOW THAT I THINK ABOUT IT its likely that he knew he was doing the bolt so might have been a last minute atempt to get people to back up.. HIS Phone(cellphone) no was going to voice mail which was full and now I dont think that NO exists.. so I guess he has vanished in to thin air.. WHO KNOWS!!!.. i only wish that I am wrong ..(somehow i dont think that will be the case) AS FOR PLANET.COM They want me to send and email to legal@.... and see what they can do in terms for getting my sites backed up or even to move to another NEW SERVER.. but somehow I dont this they want to help. |

It sucks when companies do that because it makes it harder for other small Hosting Companies to get the customers trust.
I try to use hosting companies that not only are near me but have an address on their website. I e-mail them before I buy something with technical questions. Depending on their response and how fast they reply I determined if they even care about the customer. I feel if they are willing to help you and answer your questions in a timely manner before you are a customer when you do become a customer they service customer support is usually even better. |
